The examination of the “Nano” case continues in the Court of Appeal. The witnesses have exposed all kinds of scenarios, reaching back even to the distant past of the monist period, revealing powerful and arbitrary interventions by prosecutors and accounting experts, with the aim of imposing a political conviction on the opposition leader. The latest witness, former judge at the Tirana Court, Agron Tafa, when asked by Mr Nano’s lawyer, Spartak Ngjela, whether he knew the people who had been present at a meeting on 20 July 1993, held at the General Prosecutor’s Office with the participation of the accounting expert, who at the time was working privately, said that among those present were also Members of the Albanian Parliament, Fatmir Mediu and Spartak [?]. According to the witness, he did not know the reason for the presence of these MPs at such a meeting. Meanwhile, yesterday the former head of the Tirana police, Hysen Plloçi, testified before the court. Asked whether he had knowledge of the arrest warrant for Fatos Nano, he stated that Mr Nano’s arrest was carried out on the basis of warrant no. 21-1, dated 24 June 1993, issued by the district prosecutor Fatmir Xhafa. According to the witness, the arrest warrant had been forwarded for execution through the Tirana Police Directorate. In response to lawyer Maks Haxhia’s question about whether Mr Nano’s arrest was political or not, Mr Plloçi said: “At that time the situation in Albania was very politically tense.” Meanwhile, the witness and former head of the State Control, Shkëlqim Cani, when asked whether he remembered the meeting of 20 July 1993, stated that he knew that samples of Mr Nano’s notes had been taken near the chief prosecutor’s office and that an expert examination had been carried out there by a private person. Asked by lawyer Spartak Ngjela about the statement of witness Mit'hat Havari, according to whom Mr Cani had forced his subordinates to make false statements about the “Nano” case, he declared that this was not true; on the contrary, according to him, pressure had been exerted on his subordinates by the head of the economic control sector, Vaskë Gjino, to change their testimony. In response to lawyer Viktor Gumi’s question, the witness stated that some of the accounting experts who had worked on the “Nano” case were members of the PD. In yesterday’s testimony, the former chairman of the Tirana Court, Vangjel Kosta, denied that procedural violations had occurred in the examination of the “Nano” case. According to him, the case against Fatos Nano came to court ready-made, prepared by the prosecution. The witness stated that Fatos Nano’s arrest was made by court decision. He then declared that, to his knowledge, Fatos Nano had not been ill and had not requested an expedited trial. The last witness to appear before the court panel, former chairman of the Court of Appeal, Vani Hoxha, when asked about the composition of the court panel in the “Nano” case, said that the selecting decision had been made by him. According to the witness, the “Nano” case had concluded at the Tirana Court and was awaiting examination by the Court of Appeal. Hoxha emphasized that a few days before the verdict was handed down he had been contacted by phone by the former deputy prosecutor general, Vath Kimo. According to the witness, he replied that he could not wait any longer and that a decision had to be made. Hoxha then stated that he had not had conversations with the former chairman of the Court of Cassation, Servet Muçi. The witness was also asked about the factual court’s decision to close the “Nano” trial to the public. According to him, the decision had been taken by the judge in the case because of order and calm in the courtroom. In yesterday’s session, the confrontation between the witnesses and the defendants continued.

- Declaration of the Albanian Helsinki Committee -
The Albanian Helsinki Committee, following closely the problems and concerns of the teaching staff of the University of Tirana, as well as the opposing opinions expressed regarding this issue in the public media, has reached the following conclusions:
1- Referring to articles 21-1, 22 and 34-1 of the Convention for the Protection of Human Rights and Fundamental Freedoms, as well as article 17 of the Paris Charter, concerning trade-union freedoms and the right of individuals to organize, the Albanian government has the duty to respond in time to the demands of the teaching staff of the University of Tirana. In this respect, the silence of the government authorities and their failure to respond to these problems are condemnable.
2- The involvement of government authorities and of any other person or political force in the problems of university communities, in violation of their autonomy and academic independence, is prohibited. Any such intervention is condemnable. For this reason, the Albanian Helsinki Committee considered positive the fact that the University of Tirana supported the depoliticization process as an essential principle for the development of Albanian education.
3- The Albanian Helsinki Committee considers arbitrary the actions taken against the Rector of the University of Tirana, Professor Gjovalin Shkurtaj, who has been suspended from duty in violation of articles 31-1, 32-1, 33-1, 35-1, 36 and 49/1994 of the law on higher education. This is a serious violation of university autonomy.
4- The Albanian Helsinki Committee has established that political and administrative pressure and threats have been exerted against the teaching staff of the University of Tirana, which are contrary to fundamental human rights and democratic standards.
5- The Albanian Helsinki Committee calls on the state authorities to respect the law, university autonomy and the rights of the teaching staff.

Another struggle among the youth and reformers of the new democratic countries, which began in 1991 in Eastern Europe, is the search for a way to lead the organization democratically. For FRESSH this is of particular importance because it is an organization with traditions that are also hidden by its very nature, due to the long period under totalitarianism. But this does not mean that Albanian young people are late. On the contrary, in just a few years, FRESSH has managed to become a respected organization, with an important role in the political and social life of the country.
The interview continues with assessments of the role of FRESSH in democratic processes, in the formation of the new political elite, and in cooperation with international sister organizations.
